These Membership Terms & Conditions (“Terms”) apply to all memberships purchased with The Facialist (“we”, “us”, “our”). By joining a The Facialist Membership, you (“you”, “your”, or “Member”) agree to be bound by these Terms.
1. Membership Overview
The Facialist Membership is a recurring treatment program designed to support consistent, ongoing skin health through regular professional treatments.
Memberships provide access to a set number of treatments over a 12-month membership period at a preferential membership rate, subject to these Terms.
Your membership includes:
- 12 eligible facial treatments per 12-month membership period.
- Your first treatment is secured through the initial upfront payment.
- The remaining membership balance paid through scheduled recurring installments.
- Personalised treatment recommendations based on your skin’s current needs.
- Membership pricing that is lower than the standard individual treatment price.
Membership treatments are intended to be used approximately every four weeks and are subject to availability and booking requirements.
2. Membership Payment Structure
At the time of joining, you will be required to pay an upfront amount equivalent to the cost of your first membership treatment (“Initial Payment”).
The remaining balance of your annual membership will be divided into scheduled recurring installments, as outlined at the time of purchase.
For example, under the current membership structure:
- 1 treatment is secured through the initial upfront payment.
- The remaining 11 treatments are paid through 51 weekly installments.
- The membership provides 12 treatments over a 12-month period.
The exact membership price, initial payment and instalment amount will be confirmed to you at the time of joining.
All payments are processed using the payment method authorised by you at the time of joining.
3. Recurring Payments
By joining the membership, you authorise The Facialist or its nominated payment provider to process the scheduled recurring payments associated with your membership.
You are responsible for ensuring that your nominated payment method remains valid and has sufficient funds available for each scheduled payment.
If a payment is declined or fails:
- We may contact you to arrange payment.
- A failed payment may be retried automatically.
- Your membership may be temporarily suspended until outstanding payments are brought up to date.
- Future treatment bookings may be restricted while your account is in arrears.
Any reasonable payment processing or administration fees associated with failed payments may be charged where permitted.
4. Membership Term
Your membership is for a minimum initial period of 12 months from the date of commencement.
The membership period is based on the membership schedule provided to you at the time of joining.
Membership benefits and treatment entitlements are valid only during the applicable membership period unless otherwise agreed by The Facialist.
5. Treatment Entitlements
Membership treatments are:
- Personal to the named Member.
- Non-transferable.
- Not redeemable for cash.
- Not exchangeable for retail products or cash equivalents.
- Subject to availability and advance booking.
Membership treatments cannot be transferred to another person without prior written approval from The Facialist.
Treatments must be booked in advance and are subject to The Facialist’s standard booking and cancellation policy.
6. Booking & Cancellation Policy
Membership appointments are subject to The Facialist’s standard booking and cancellation policy.
We require at least 48 hours’ notice to cancel or reschedule an appointment.
If you cancel within the applicable cancellation period, fail to attend your appointment, or arrive too late for your treatment to be performed in full, the treatment may be considered redeemed.
The Facialist reserves the right to charge a cancellation or no-show fee in accordance with its current booking policy.
7. Treatment Expiry
Membership treatments are intended to be used regularly throughout the 12-month membership period.
Unused treatments do not automatically carry over beyond the membership expiry date.
Any unused treatment entitlements at the end of the membership term will expire unless The Facialist agrees otherwise in writing.
8. Membership Cancellation
Memberships are subject to the minimum 12-month membership commitment.
If you wish to cancel your membership before the end of the initial 12-month term, you must contact The Facialist in writing.
Where permitted, early cancellation may require payment of any outstanding balance associated with treatments already received or other amounts due under the membership.
Membership pricing is offered on the basis of the agreed membership commitment. If the membership is terminated early, The Facialist reserves the right to recalculate treatments already received at the applicable standard treatment price and charge any difference between the standard treatment price and the membership price paid.
Any outstanding balance must be paid before the membership is considered fully cancelled.
9. Membership Renewal
At the end of the initial membership term, your membership may continue or renew under the applicable renewal terms communicated to you by The Facialist.
Any renewal terms, pricing or changes to membership benefits will be communicated to you before the renewal takes effect.
10. Changes to Membership
The Facialist reserves the right to update membership pricing, treatment offerings, membership benefits or these Terms from time to time.
Any changes that materially affect an existing membership will be communicated to Members where required.
Existing Members will continue under their agreed membership pricing and terms for the current membership period unless otherwise agreed.
11. Membership Benefits
Membership benefits are available only to the named Member and cannot be combined with other promotions, discounts, offers or vouchers unless expressly stated.
Additional membership benefits may be introduced from time to time and may be subject to separate terms.
12. Gift Cards & Vouchers
Membership treatments cannot be exchanged for gift cards or vouchers.
Gift cards and vouchers cannot be used to pay membership instalments unless expressly approved by The Facialist.
13. Refunds
Membership payments are non-refundable once processed.
The initial payment and recurring instalments are payments toward the agreed membership program and are not individual prepaid treatment vouchers.
Any refund request will be assessed in accordance with these Terms and applicable New Zealand consumer law.
14. Personal Information
By joining the membership, you consent to The Facialist collecting and using your personal information for the purposes of administering your membership, processing payments, managing appointments and communicating with you about your membership.
Your personal information will be handled in accordance with The Facialist’s Privacy Policy.
15. Suspension or Termination by The Facialist
The Facialist may suspend or terminate a membership if:
- Payments remain overdue.
- A Member repeatedly breaches the booking or cancellation policy.
- A Member engages in abusive, threatening or inappropriate behaviour toward staff.
- The membership is being misused or transferred without approval.
- The Member otherwise materially breaches these Terms.
Where a membership is terminated due to a Member’s breach, any outstanding amounts owing remain payable.
16. Business Closure or Unforeseen Circumstances
If The Facialist is unable to provide membership services due to circumstances beyond its reasonable control, including natural disasters, government restrictions, significant operational disruption or other unforeseen events, we will make reasonable efforts to provide affected Members with an appropriate solution.
This may include extending the membership period, rescheduling treatments or providing an alternative arrangement.
17. Consumer Rights
Nothing in these Terms is intended to exclude, restrict or modify any rights you may have under applicable New Zealand consumer protection laws.
Where any provision of these Terms is inconsistent with a non-excludable legal right, that legal right will prevail.
18. Acceptance of Terms
By purchasing a The Facialist Membership, you confirm that you have read, understood and agreed to these Membership Terms & Conditions.
You acknowledge that the membership is a recurring payment commitment and that you are responsible for all payments due under your agreed membership schedule.
